1. Acceptance of Terms

By downloading, accessing, or using PregnantWise ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Eligibility

You must be at least 18 years old to use this App. By using the App, you represent and warrant that you meet this requirement.

3. Description of Service

PregnantWise is a pregnancy nutrition and wellness tracking application that allows users to:

Track daily nutrition, water intake, and supplements
Monitor pregnancy progress and symptoms
Share selected data with a connected partner
Generate wellness reports and insights
Export nutrition data as PDF reports for healthcare provider visits
Access pregnancy toolkit features (kick counter, contraction timer, kegel exercises, hospital bag checklist)
View nutrition analytics and trends dashboard
Access food safety information (safe, caution, avoid ratings)
Create and save custom recipes and ingredients
Build meal plans and shopping lists
Access educational pregnancy resources by week and trimester

4. Medical Disclaimer

IMPORTANT: PREGNANTWISE IS NOT A MEDICAL DEVICE.

The App provides general information and tracking tools only. It does not provide medical advice, diagnosis, or treatment. The nutritional goals, insights, and recommendations are for informational purposes only.

Always seek the advice of your physician, obstetrician, or other qualified healthcare provider with any questions you may have regarding your pregnancy, nutrition, or medical condition.

Never disregard professional medical advice or delay seeking it because of something you have read or tracked in this App.

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials
You agree to provide accurate and complete information when creating your account
You are responsible for all activities that occur under your account
You must notify us immediately of any unauthorized use of your account

6. Partner Sharing Feature

The Partner Link feature allows you to share selected health data with one connected partner
You control what data is shared through Sharing Preferences
By using this feature, you consent to your selected data being visible to your partner
You can disconnect your partner at any time, which will revoke their access

7. User Content

You retain ownership of any content you submit to the App
By submitting content, you grant us a license to use, store, and process it to provide the service
You agree not to submit content that is illegal, harmful, or violates others' rights

8. Prohibited Uses

You agree not to:

Use the App for any unlawful purpose
Attempt to gain unauthorized access to the App or its systems
Interfere with or disrupt the App's operation
Use automated means to access the App without permission
Share your account with others or create multiple accounts

9. Intellectual Property

The App and its original content, features, and functionality are owned by PregnantWise and are protected by international copyright, trademark, and other intellectual property laws.

10. Termination

We may terminate or suspend your access immediately, without prior notice, for any breach of these Terms
You may delete your account at any time through the App settings
Upon termination, your right to use the App will cease immediately

11. Limitation of Liability

To the maximum extent permitted by law, PregnantWise shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Loss of profits, data, or other intangible losses
Any decisions made based on App information
Any health outcomes related to App usage

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes through the App or by email. Your continued use of the App after such changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in California, and you consent to the jurisdiction of such courts.

15. Guest Mode

You may use PregnantWise as a guest without creating an account.

Guest Limitations:

3 food searches per day
2 food logs per day
2 water entries per day
Limited analytics (today only)
No partner connection, PDF export, meal planning, or shopping list
No data sync or backup

Data Handling:

Guest data is stored locally on your device only
After 90 days of inactivity, guest accounts are automatically deleted
If you create an account, your guest data will be migrated

Conversion:

You may convert to a full account at any time
If your email is already registered, you can link accounts
Converting preserves your existing guest data

16. Subscription & Billing

Paid Features:

The "Couples Plan" provides premium features for you and your connected partner
Only the subscriber needs to pay; the linked partner receives premium access for free
Premium features include unlimited searches, meal planning, PDF export, and analytics

Billing:

Subscriptions are processed through Apple App Store or Google Play, with RevenueCat as our subscription management intermediary. RevenueCat receives anonymized purchase status but does not access your payment details.
Subscription auto-renews unless cancelled at least 24 hours before the end of the current period
Price changes will be communicated in advance via the App or email

Cancellation:

Cancel via your device's app store subscription settings (iOS: Settings > Apple ID > Subscriptions; Android: Google Play Store > Profile > Payments & Subscriptions)
Access continues until the end of the current billing period
No partial refunds for unused subscription time

Free Trial:

All subscription plans include a 3-day free trial
You will not be charged during the trial period
You may cancel during the trial at no charge
After the trial, your subscription automatically renews at the plan price unless cancelled at least 24 hours before the trial ends

Important: Deleting your account does NOT automatically cancel your subscription. You must cancel your subscription separately through your device's app store settings before deleting your account to avoid future charges.

17. Account Deletion

30-Day Grace Period:

When you delete your account, it enters a 30-day soft-delete period
During this time, your data is preserved but inaccessible
You may restore your account by logging back in within this period
Your partner will be notified but their access will be temporarily suspended

After Grace Period:

Private recipes are permanently deleted
Public recipes are anonymized (creator shown as "Deleted User")
Personal health data is removed
This action cannot be undone

Immediate Deletion:

You may request immediate permanent deletion (Right to Be Forgotten)
This option is available during the deletion process
Immediate deletion cannot be undone

18. Data Export Rights

You have the right to:

Export all your personal data at any time via Settings > Account
Receive your data in a machine-readable format
Export links expire after 24 hours for security

Export includes:

Profile information and preferences
Nutrition logs and daily tracking data
Custom recipes and ingredients
Meal plans and shopping lists
Symptom logs and wellness data

19. Third-Party Services

PregnantWise integrates with third-party services:

Supabase - Database storage and user authentication
RevenueCat - Subscription and purchase management
Sentry - Crash reporting (with PHI scrubbing for privacy)
Expo - Push notification delivery
Apple/Google - Push notifications, app distribution, and payments

Each third-party service operates under its own terms of service and privacy policy. By using PregnantWise, you acknowledge and accept these integrations.

20. Force Majeure

We shall not be liable for any failure to perform our obligations where such failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, or technical failures of third-party services.

21. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.

22. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and PregnantWise regarding your use of the App.

23. Waiver

Our failure to enforce any provision of these Terms shall not be considered a waiver of our right to enforce such provision or any other provision in the future.

24. Assignment

We may assign or transfer these Terms, and any rights and licenses granted hereunder, without restriction. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
